Safety and Privacy Policy of the Web Page

PWC, a Company located in San José, Costa Rica, is the holder of the website sistemasalarial.pwc.com. Access to the web page is free except for the cost of the connection through the telecommunications network provided by the access provider contracted by the users. Certain services are exclusive to our clients and their access is restricted.

Using the website attributes the condition of the user and implies the acceptance of all the conditions included in this Legal Notice. The provision of the website service is limited to the moment in which the user is properly subscribed to the Salary Information Survey System. Therefore, the user must carefully read this Legal Notice in each one of the occasions in which it intends to use the portal, since this and its conditions of use, contained in this Legal Notice, are subject to modification.

The web page sistemasalarial.pwc.com is a website that provides general information related to recruitment and selection processes. All the contents of the site or the links existing to other sites are only for the purposes mentioned above and the user accepts the use of the information hereby included.

The services that PWC renders have the price indicated in the subscription contract or that is sent through e-mail or given by telephone.

Intellectual Property.

There are reserved all rights for Industrial and Intellectual Property of the elements that integrate the contents of this web page, understanding by these without limitation, text, photographs, designs, graphics, images, menus, navigation buttons, icons, technology, software, links and other audible or visual content, as well as its graphic design and source code (hereinafter "Contents") and any other content of the web page.

The trademarks, trade names or distinctive signs, are the property of PWC or third parties, without that it can be understood that the access to the portal confers no right on the above-mentioned trademarks, trade names and/or distinctive signs.

Usage Conditions of the Portal

General

The user is obliged to make a correct use of the website in accordance with the laws and the current Legal Notice. The user shall be liable before PWC or third parties of any damage that may be caused as a result of a breach of this obligation.

It is expressly forbidden the use of the website with injurious aims of goods or interests of PWC or through third parties, or that of any other way overloaded, harm or cancel networks, servers and other computer equipment (hardware) or products and computer applications (software) of PWC or of third parties.

Contents

The user agrees to use the content in accordance with the laws and the this current Legal Notice, as well as with the other conditions, regulations and instructions that in the case could be applied in accordance with the previous clauses.

Including but not limited to the fact that the user shall refrain from making the following actions (without being limited to the same):

  • Reproduce, copy, distribute, make available, publicly communicate, transform or modify the contents, except in cases authorized by law or expressly consented to by PWC or by the person who holds the title of exploitation rights in its case.
  • Reproduce or copy, for private use the contents that may be considered as Software or database in accordance with the laws in force in the field of intellectual property, as well as its public communication or when it is available to third parties when these acts necessarily involve the playback by the user or a third party.
  • Remove and/or reuse all or a substantial part of the contents of the portal as well as for the databases that PWC put at the disposal of users.

Data Collection Forms

The use of certain services or requests addressed to PWC is conditioned to the fact that the user makes the corresponding registration of his/her data. Any information that the user provides through the physical forms or the portal for the previous effects or any other must be truthful and comply with what it is stated in the informed consent.

For these purposes, the user guarantees the authenticity of all data that communicates and will maintain the information provided to PWC perfectly updated in such a way as to respond, at all times, to the real situation of the user.

In any case the user will be solely responsible for the false or inaccurate statements made and for any damages caused to PWC or to third parties due to the information provided.

Responsibility Exclusion

Information

Access to the portal does not imply an obligation of PWC to verify the truthfulness, accuracy, adequacy, suitability, completeness and currency of the information provided through the same. Similarly, PWC is hereby authorized by those who enter to confront, confirm, review, request, transfer, assign, or obtain information or confirmation of the same, which is included in the forms that are made available to the user.

PWC is not responsible for the decisions made on the basis of the information provided in the portal or the damages caused to the user or any third party with reason of performances that have, as the sole basis, the information obtained in the website.

The content of this site has an exclusive informative purpose and should not be considered as an indication of future results. The implementation and impact of laws can widely vary based on specific facts involved. PWC is not responsible for any damages incurred in the computer equipment, telematics or any other type of users or third parties during the provision of the service of the website.

The availability of the service

The access to the portal requires services and supplies from third parties, including the transport via telecommunications networks whose reliability, quality, continuity and operation does not correspond to PWC. Therefore, the services provided through the portal can be suspended, canceled or be inaccessible, with prior or simultaneous character to the provision of the service of the website.

PWC shall not be responsible for damages or prejudices of any kind caused to the user that bring cause of faults or disconnections in telecommunication networks that produce the suspension, cancellation or interruption of the service of the portal during the provision of the same or with previous character.

The contents and services linked through the website

The service of access to the website includes technical linking devices, directories and even search tools that allow the user to access other pages and Internet portals (hereinafter "Linked Sites"). In these cases, PWC only will be responsible for the content and services provided in the Linked Sites to the extent that it is actual knowledge of wrongfulness and have not turned off the link with the corresponding diligence. On the assumption that the user considers that there is a Linked Site to illicit or inadequate content, he/she may notify it to PWC through the address diangie.ovares@cr.pwc.com, but in no case this communication entails the obligation to remove the corresponding link.

In none case, the existence of Linked Sites must presuppose the existence of agreements with the responsible or holders of the same, nor the recommendation, promotion or identification of PWC with demonstrations, content or services provided.

PWC does not know the contents and services of the Linked Sites and therefore is not responsible for damage caused by the wrongfulness, quality, downgrade, unavailability, error and uselessness of the contents and/or services of the Linked sites or any other damages that are not directly attributable to PWC.

Protection of personal data

We would like to inform the client that the personal data and information the client provides to us when completing any electronic form available in the website, will be incorporated in a data file of personal ownership of PWC. When entering into the home page, the user authorizes the automated or manual treatment of the data the client provides to use the submission of information by means of the forms, or write to any email address. The data provided may be disclosed to third parties, as long as they are used in lawful purposes and in a safe manner. The user accepts these conditions established, by entering the web page of PWC, as well as when the client presses the button “SEND” or “SAVE” that is in the form (if available). The purpose of the treatment of the data was to respond to the client´s request and provide the services of PWC. The questions included in each of the forms are of voluntary nature, except those marked with an asterisk (*) which are mandatory. In the case of not answering the required questions, PWC reserves the right to not incomplete process applications or not to provide the services requested. The personal information gathered from registered users is stored in databases owned by PWC, or third-party databases that meet the security measures established by law, and to which PWC assumes the measures of technical, organizational and security to ensure the confidentiality, and integrity of the information provided.

Any user can exercise the right to access, rectify, or delete their data provided through electronic communication sent to PWC to the electronic address diangie.ovares@cr.pwc.com.

Communications of data to third parties

In order to meet the client´s demand, or request for information, it may be necessary for the client´s data to be transferred by PWC to its offices in the following countries: Costa Rica, Panama, Nicaragua, Honduras, El Salvador, Guatemala, Dominican Republic and other countries. The databases that lodges the personal information provided by the owner will have the benefit of the security measures established by law.

Commercial communications

In any of the electronic forms the client´s express consent will be requested to be able to refer commercial communications by any means, including electronic mail or equivalent electronic means of communication.

Security Measures

PWC adopts the levels of security required, for the proper functioning of the page, and which are appropriate to the nature of the data that are subject of treatment in each moment. Notwithstanding the foregoing, the technical security in an environment such as the Internet is not impregnable and there may be malicious actions of third parties, even when PWC puts all the means at its disposal to prevent such actions.

Cookies Usage Policy

PWC uses storage and data recovery devices (“Cookies”), the user when entering into the portal gives its prior consent to do so.

A "cookie" is a small data file that can be placed on the hard drive of the client´s computer or on a web server. These cookies do not retrieve the information stored on the client´s hard drive and cause no harm to the client´s computer or to the files that are stored in it. The client is not obliged to accept a cookie, and in fact, the client can modify the client´s browser to not accept cookies. We use cookies for our site web to recognize the client´s preferred language, which is selected from a previous visit to our site. We also did a follow-up to the navigation patterns of our users through our web page, in order to evaluate and improve the site. We use this information to compile statistical data on the use of our web site, but this information is used anonymously, aggregated and the client cannot be identified from it.

When the client visits our web site, our server logs the client´s IP address along with the date, time and duration of the client´s visit. An IP address is an assigned number, similar to a telephone number, which lets the client´s computer to communicate through Internet. We analyze this data to obtain statistical trends.

Rights of Access, Rectification, Modification, Revocation and Elimination

The user may exercise his/her rights of access, rectification, modification, revocation or elimination in the terms stipulated by law and should send a communication via e-mail to the following address: diangie.ovares@cr.pwc.com, indicating in any of the cases, his/her first and last name, and the company to which it belongs. The user must clearly indicate the client´s request and provide evidence to prove the client´s ownership.

Activities of illicit and inappropriate communication

In the event that the user or any other Internet user is aware that the Linked Sites refer to pages whose content or services are illegal, harmful, denigrating, and violent or contrary to the morality the user will be able to contact PWC stating the following:

  • The informant personal data: name, address, phone number and email address;
  • Description of the facts that reveal the illegal or inappropriate nature of the Linked Site;
  • In the event of a violation of rights, such as intellectual and industrial property, the personal data of the holder of the right is infringed when it is someone other than the communicator. Likewise, the user must provide the title attesting to the legitimacy of the holder of the rights and, in its case, the representation to act on behalf of the holder when it is a person other than the communicator;
  • Explicit statement that the information contained in the claim is accurate.

The reception by PWC of notice under this clause will not expect the actual knowledge of the activities and/or contents indicated by the informant.

The user must also provide the title attesting to the legitimacy of the holder of rights and, in his/her case, the representation to act on behalf of the holder when it is a person other than the informer; also to provide explicit statement that the information contained in the claim is accurate.

Notice of Confidentiality of Electronic Mails

All information contained in any e-mail that is issued by the domain sse-plus.com or whose destination is an e-mail belonging to @cr.pwc.com; as well as any other document attached to the message is for the exclusive use of the sender and the addressee and may contain confidential or privileged information. In case of receiving a wrong e-mail without being the recipient, the user will need to notify immediately to PWC to the e-mail diangie.ovares@cr.pwc.com and immediately destroy all copies of this message, as well as any attachment.

In order to inform the user, it indicates that there are computer viruses and malicious programs or malware that can be transmitted via e-mail. By the above, the user is the one who has an obligation to keep the appliance of emission and reception of mails free of viruses or other programs that may damage the systems of PWC; similarly, the user is solely responsible for the fact that the computer in which he/she will receive mails could be infected by a virus or any malignant or malicious system. PWC shall not be liable for any damage resulting from the emission or reception of emails that circulate on its servers.

PWC does not ensure that the transmission of emails will be totally safe, any information that circulate through electronic means may be intercepted, manipulated, destroyed, lost, deleted, infected, partially or completely. By the foregoing PWC is not responsible for errors or omissions in the content of their emails resulting from electronic transmissions.

Legislation

The current Legal Notice is governed in each and every one of its ends by the law of the Republic of Costa Rica.
